These Terms of Service ("Terms") govern your access to and use of the MagnetArt website located at https://magnetart.com.au (the "Website"), together with all products, services, software, digital tools, content, and custom manufacturing services offered through the Website.

The Website is owned and operated by MagnetArt – Malka Net Pty Ltd (ABN 85 636 962 742) ("MagnetArt", "Company", "we", "our", or "us").

By accessing the Website, creating an account, uploading images, placing an order, or otherwise using any part of our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, and any other policies published on our Website.

If you do not agree with these Terms, you must immediately discontinue use of the Website and our Services.


1. Definitions

For the purposes of these Terms:

"Customer", "you", and "your" mean any individual, business, organisation, or entity using the Website or purchasing products or services from MagnetArt.

"Company", "MagnetArt", "we", "our", and "us" refer to Malka Net Pty Ltd.

"Website" means https://magnetart.com.au together with all associated webpages, software, applications, and online services.

"Services" means all products, custom manufacturing services, image processing services, customer support, software, and related services provided by MagnetArt.

"Products" means all customised aluminium wall art, accessories, mounting systems, replacement products, and other items sold by MagnetArt.

"Uploaded Content" means any photograph, artwork, image, logo, design, illustration, graphic, text, file, or other material uploaded or submitted by a customer.


2. Eligibility

By using the Website you confirm that:

  • You are at least 18 years of age or have legal authority to enter into binding contracts.

  • You have the legal capacity to accept these Terms.

  • All information provided by you is accurate and complete.

  • You will promptly update any information that becomes inaccurate.

If you use this Website on behalf of a company, employer, partnership, trust, or other organisation, you warrant that you have authority to bind that organisation to these Terms.


3. Changes to these Terms

MagnetArt may amend, modify, replace, or update these Terms at any time without prior notice.

Changes become effective immediately upon publication on the Website.

Your continued use of the Website following publication of revised Terms constitutes your acceptance of those changes.

It is your responsibility to review these Terms periodically.


4. Website Use

You agree to use this Website only for lawful purposes.

You must not:

  • Use the Website in violation of any applicable law.

  • Upload malicious software, viruses, ransomware, spyware, or harmful code.

  • Attempt to gain unauthorised access to our systems.

  • Circumvent Website security measures.

5. Customer Accounts

Customers may create an account to simplify future purchases.

You are responsible for:

  • Maintaining the confidentiality of your login credentials;

  • Restricting access to your account;

  • All activities occurring under your account.

You must immediately notify MagnetArt if you suspect unauthorised access to your account.

MagnetArt is not responsible for losses resulting from unauthorised use of customer accounts.


6. Products & Services

MagnetArt manufactures personalised aluminium wall art and related custom products based on customer specifications.

Every product is manufactured specifically for each customer using customer-supplied images, selected sizes, finishes, and options.

Because products are custom-made:

  • Product images displayed on the Website are for illustrative purposes only.

  • Colours, finishes, textures, brightness, contrast, and appearance may vary between computer screens, mobile devices, printed materials, and the final manufactured product.

  • Measurements are approximate.

  • Minor manufacturing variations are normal and do not constitute defects.

MagnetArt continuously improves its products and reserves the right to modify product specifications, materials, packaging, manufacturing processes, or designs without notice.


7. Product Availability

All products are subject to availability.

MagnetArt reserves the right to:

  • discontinue products;

  • modify specifications;

  • substitute equivalent materials;

  • limit quantities;

  • reject bulk orders;

  • cancel products that become unavailable.

If a product becomes unavailable after purchase, we may:

  • issue a refund;

  • provide store credit;

  • offer an alternative product;

  • contact you to discuss available options.


8. Pricing

All prices displayed on the Website are shown in the applicable currency selected on the Website.

Prices may change without notice.

Pricing errors may occasionally occur.

If an obvious pricing error is identified after an order is placed, MagnetArt reserves the right to:

  • cancel the order;

  • contact the customer to offer the correct price;

  • issue a full refund.

Customers are responsible for any taxes, customs duties, import duties, brokerage fees, VAT, GST, or government charges applicable within their jurisdiction unless expressly stated otherwise.


9. Payment

Payment must be successfully received before production begins.

MagnetArt accepts payment using payment methods offered during checkout.

Payments are securely processed by Shopify and its authorised payment providers.

MagnetArt does not store full credit card information.

If payment is declined, reversed, cancelled, disputed, or otherwise fails, MagnetArt may:

  • suspend production;

  • refuse shipment;

  • cancel the order;

  • recover outstanding amounts;

  • recover collection costs where legally permitted.

Ownership of Products remains with MagnetArt until payment has been received in full.


10. Order Acceptance

Submission of an order does not guarantee acceptance.

All orders remain subject to review and acceptance by MagnetArt.

We reserve the absolute discretion to refuse or cancel any order where we reasonably believe:

  • incorrect pricing exists;

  • fraudulent activity is suspected;

  • payment cannot be verified;

  • supplied information is inaccurate;

  • Uploaded Content may infringe third-party rights;

  • the order breaches applicable law;

  • the order cannot reasonably be fulfilled;

  • continued processing may expose MagnetArt to legal, financial, reputational, or operational risk.

If payment has already been received, a refund will be issued where appropriate.


11. Order Changes

Because every product is custom manufactured, customers should carefully review all information before completing their purchase.

Requests to change or cancel an order will only be considered if production has not yet commenced.

Once production begins, MagnetArt may be unable to accommodate changes or cancellations.

Any approved changes may result in additional charges and revised production timeframes.


12. Production Time

Estimated production and delivery times are provided as guides only.

Production schedules may vary due to:

  • order volume;

  • supplier delays;

  • equipment maintenance;

  • shipping disruptions;

  • public holidays;

  • customs processing;

  • force majeure events;

  • circumstances beyond our reasonable control.

MagnetArt is not liable for losses arising from estimated production or delivery timeframes.


13. Right to Refuse Service

To protect our customers, employees, suppliers, and business operations, MagnetArt reserves the right, at its sole discretion and without prior notice, to:

  • refuse service;

  • refuse future orders;

  • suspend customer accounts;

  • cancel transactions;

  • decline production;

  • refuse uploaded files;

  • restrict Website access.

This right may be exercised where reasonably necessary to protect our legal rights, comply with applicable laws, prevent fraud, safeguard intellectual property, maintain operational integrity, or address abusive, threatening, unlawful, or inappropriate conduct.

Nothing in this clause limits any rights that customers may have under the Australian Consumer Law where those rights cannot legally be excluded.


14. Customer Uploaded Content

MagnetArt manufactures custom-made products using images, artwork, logos, graphics, photographs, and other materials supplied by customers ("Uploaded Content").

You acknowledge that all Uploaded Content is provided voluntarily by you solely for the purpose of manufacturing your requested custom product.

You retain ownership of your Uploaded Content, subject to the licence granted to MagnetArt under these Terms.


15. Customer Warranties

By uploading any Uploaded Content or placing an order with MagnetArt, you represent and warrant that:

  • You own all necessary copyrights, trademarks, intellectual property rights, licences, permissions, and authorisations relating to the Uploaded Content; or

  • You have obtained all necessary permissions from the lawful rights holder to use, reproduce, modify where reasonably necessary for production, manufacture, print, and distribute the Uploaded Content for the purposes of your order.

  • The Uploaded Content does not infringe any copyright, trademark, patent, design right, moral right, privacy right, publicity right, confidential information, or any other legal rights of any third party.

  • The Uploaded Content does not contain unlawful, defamatory, offensive, misleading, fraudulent, obscene, hateful, or otherwise prohibited material.

  • All information provided by you is true, complete, and accurate.

You acknowledge that MagnetArt relies entirely upon these representations when accepting and processing your order.


16. Licence Granted to MagnetArt

By uploading Uploaded Content, you grant MagnetArt a limited, non-exclusive, worldwide, royalty-free, revocable licence to:

  • Receive and store your Uploaded Content;

  • Review your Uploaded Content for production purposes;

  • Resize, crop, sharpen, optimise, colour-correct, and otherwise make reasonable technical adjustments necessary for manufacturing;

  • Produce, print, package, and deliver your customised products;

  • Store your Uploaded Content for customer support, warranty claims, replacement orders, and order verification;

  • Use your Uploaded Content solely to fulfil your order and related customer service requirements.

This licence does not permit MagnetArt to use your Uploaded Content for advertising, marketing, or promotional purposes without your separate consent.

This licence automatically terminates once your Uploaded Content has been permanently deleted from our systems, except where retention is required by law or for the resolution of disputes.


17. Production Adjustments

To achieve the best possible manufacturing results, MagnetArt may make reasonable technical adjustments to Uploaded Content, including:

  • Cropping;

  • Resizing;

  • Colour correction;

  • Brightness and contrast adjustments;

  • Sharpening;

  • Resolution optimisation;

  • Background clean-up where appropriate;

  • File format conversion;

  • Other production-related adjustments necessary for manufacturing.

These adjustments are made solely for production purposes and do not transfer ownership of your Uploaded Content.


18. Image Quality

Customers are responsible for ensuring that Uploaded Content is suitable for printing.

MagnetArt is not responsible for print quality issues resulting from:

  • Low-resolution images;

  • Blurry photographs;

  • Compression artefacts;

  • Poor lighting;

  • Incorrect colour profiles;

  • Images supplied in unsuitable formats;

  • Customer-approved artwork.

Actual printed colours may vary from colours displayed on computer monitors, mobile devices, tablets, or printed proofs due to differences in display technologies, lighting conditions, printing processes, and materials.

Minor variations in colour, brightness, positioning, cropping, texture, finish, and overall appearance are considered normal characteristics of custom manufacturing and do not constitute defects.


19. Intellectual Property

All Website content, including but not limited to:

  • Logos;

  • Branding;

  • Product photography;

  • Mock-ups;

  • Designs created by MagnetArt;

  • Website layout;

  • Software;

  • Graphics;

  • Text;

  • Icons;

  • Product descriptions;

  • Videos;

  • Marketing materials;

remain the exclusive property of MagnetArt or its licensors.

Nothing contained within these Terms transfers ownership of MagnetArt's intellectual property to any customer.

Except where permitted by law or with prior written consent, you must not copy, reproduce, distribute, publish, modify, create derivative works from, or commercially exploit any MagnetArt intellectual property.


20. Copyright & Intellectual Property Complaints

MagnetArt respects the intellectual property rights of others.

If any person believes that content submitted to MagnetArt infringes their intellectual property rights, they should contact us immediately at:

The notice should include sufficient information to identify:

  • The allegedly infringed intellectual property;

  • The relevant order or content;

  • The basis of the complaint;

  • Evidence supporting ownership or authority.

Upon receiving a complaint, MagnetArt may:

  • Suspend production;

  • Delay shipment;

  • Request additional information;

  • Cancel the order;

  • Remove Uploaded Content from our systems where appropriate;

  • Take any other action reasonably necessary to comply with applicable law.


21. Right to Refuse or Cancel Orders

MagnetArt reserves the right, at its reasonable discretion, to refuse, suspend, delay, or cancel any order where we reasonably believe that the Uploaded Content:

  • May infringe copyright;

  • May infringe trademark rights;

  • May infringe intellectual property rights;

  • May violate privacy or publicity rights;

  • May breach applicable law;

  • May expose MagnetArt to legal or regulatory risk;

  • Contains unlawful, abusive, threatening, discriminatory, or offensive material.

Where appropriate, MagnetArt may request replacement artwork before proceeding with production.

If an order is cancelled before production commences, a refund may be provided in accordance with our Refund Policy and applicable law.


22. Storage of Uploaded Content

Uploaded Content may be retained for a reasonable period after completion of an order for customer support, warranty claims, replacement orders, quality assurance, dispute resolution, and compliance with legal obligations.

MagnetArt may permanently delete Uploaded Content once it is no longer reasonably required.

Customers are responsible for maintaining their own backup copies of all Uploaded Content.


23. Customer Responsibility

Customers remain solely responsible for:

  • The legality of all Uploaded Content;

  • Obtaining all necessary permissions and licences;

  • Verifying spelling, grammar, dates, and artwork before placing an order;

  • Reviewing previews or proofs provided by MagnetArt (where applicable);

  • Ensuring that Uploaded Content is suitable for the intended purpose.

MagnetArt is not responsible for customer-supplied errors that are reproduced in accordance with the customer's submitted files or approved proofs.


24. Production

All MagnetArt products are custom-made to each customer's specifications.

Production will commence only after:

  • Payment has been successfully received;

  • Required files have been uploaded;

  • Any necessary production requirements have been satisfied.

Production timeframes published on our Website are estimates only and are not guaranteed.

Production may be delayed due to:

  • High order volumes;

  • Supplier shortages;

  • Equipment maintenance;

  • Public holidays;

  • Shipping disruptions;

  • Customs inspections;

  • Force majeure events;

  • Circumstances beyond MagnetArt's reasonable control.

MagnetArt is not liable for losses arising solely from reasonable production delays.


25. Shipping & Delivery

Shipping estimates are provided in good faith and are not guaranteed delivery dates.

Once an order has been dispatched, delivery is the responsibility of the selected shipping carrier.

MagnetArt is not responsible for delays caused by:

  • Courier companies;

  • Customs authorities;

  • Weather events;

  • Industrial action;

  • Incorrect delivery information supplied by the customer;

  • Failed delivery attempts;

  • Circumstances outside our reasonable control.

Customers are responsible for providing an accurate delivery address.

Additional shipping costs resulting from incorrect or incomplete delivery information may be charged to the customer.

Risk in the Products passes to the customer upon delivery, or where permitted by law, when the Products are handed to the carrier for delivery.


26. Inspection of Orders

Customers should inspect all Products promptly upon delivery.

If a Product is received damaged, defective, or incorrect, customers should notify MagnetArt as soon as reasonably practicable and provide:

  • Order number;

  • Description of the issue;

  • Clear photographs showing the Product and packaging where applicable.

Failure to notify us within a reasonable time may affect our ability to investigate claims, subject to your rights under applicable law.


27. Custom Products

Because every Product is manufactured specifically for each customer, custom Products cannot generally be resold.

For this reason, change-of-mind returns, exchanges, or cancellations after production has commenced are generally not available.

Nothing in this clause limits any rights that cannot legally be excluded under the Australian Consumer Law.


28. Returns & Refunds

Returns and refunds are governed by our Refund Policy and applicable Australian law.

Subject to the Australian Consumer Law, refunds or replacements may be available where Products:

  • Are faulty;

  • Have a major manufacturing defect;

  • Are significantly different from the accepted order specifications;

  • Do not meet consumer guarantees that cannot legally be excluded.

Refunds or replacements will generally not be available where issues arise from:

  • Customer-supplied images;

  • Low-resolution files;

  • Customer-approved artwork;

  • Customer spelling or design errors;

  • Colour expectations based solely on screen displays;

  • Minor manufacturing tolerances.


29. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights, guarantees, remedies, or other protections available under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded.

Where permitted by law, MagnetArt limits its liability to one or more of the following remedies at its option:

  • Repair of the Product;

  • Replacement of the Product;

  • Resupply of the relevant service; or

  • Refund of the amount paid for the affected Product or service.


30. Product Warranty

MagnetArt warrants that Products will be manufactured with reasonable care and skill using commercially accepted production methods.

This warranty does not cover:

  • Normal wear and tear;

  • Accidental damage;

  • Improper installation;

  • Incorrect handling;

  • Exposure to excessive moisture, heat, chemicals, or sunlight;

  • Misuse;

  • Damage occurring after delivery;

  • Customer-supplied artwork or image quality issues.

Warranty claims may require photographic evidence and proof of purchase.


31. Colour Accuracy

Customers acknowledge that colours displayed on electronic devices are approximate only.

Printed colours may vary due to:

  • Screen calibration;

  • Device settings;

  • Lighting conditions;

  • Printing technology;

  • Aluminium surface characteristics;

  • Manufacturing tolerances.

Reasonable colour variation does not constitute a manufacturing defect.


32. Installation

Customers are responsible for correctly installing Products using the supplied mounting system and following any installation instructions provided.

MagnetArt is not responsible for damage resulting from:

  • Incorrect installation;

  • Unsuitable wall surfaces;

  • Failure to follow installation instructions;

  • Misuse of mounting components;

  • Structural defects in walls or buildings.

Customers should independently determine whether the chosen mounting method is suitable for their installation environment.


33. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website, Products, and Services are provided on an "as is" and "as available" basis.

Except for rights that cannot legally be excluded, MagnetArt makes no representation or warranty that:

  • The Website will operate uninterrupted or error-free;

  • The Website will always be available;

  • The Website will be free from viruses or malicious code;

  • Every uploaded image will produce identical printed results;

  • Products will exactly match colours displayed on electronic devices.


34. Limitation of Liability

To the maximum extent permitted by applicable law, MagnetArt shall not be liable for any indirect, incidental, consequential, exemplary, special, or punitive loss or damage, including but not limited to:

  • Loss of profits;

  • Loss of revenue;

  • Loss of business opportunities;

  • Loss of goodwill;

  • Loss of data;

  • Business interruption;

  • Third-party claims arising from matters beyond MagnetArt's reasonable control.

Where liability cannot legally be excluded, MagnetArt's liability is limited to the remedies available under the Australian Consumer Law or other applicable legislation.

Nothing in these Terms excludes liability for matters that cannot legally be excluded under applicable law.


35. Force Majeure

MagnetArt will not be responsible for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to:

  • Natural disasters;

  • Fire;

  • Flood;

  • Pandemic;

  • Epidemic;

  • Government action;

  • War;

  • Civil unrest;

  • Industrial disputes;

  • Power outages;

  • Telecommunications failures;

  • Cybersecurity incidents;

  • Supplier failures;

  • Transportation disruptions.

During such events, MagnetArt's obligations will be suspended for the duration of the event to the extent reasonably necessary.


36. Fraud & Payment Disputes

MagnetArt reserves the right to investigate suspected fraudulent transactions, payment disputes, unauthorised payment activity, or abuse of the ordering process.

Where reasonably necessary to protect our business or comply with legal obligations, we may:

  • Delay production;

  • Suspend shipment;

  • Request identity verification;

  • Cancel an order;

  • Cooperate with payment providers and law enforcement authorities.

Nothing in this clause limits any rights available to customers under applicable law.


37. Suspension and Termination

MagnetArt reserves the right, at its reasonable discretion, to suspend, restrict, or terminate your access to the Website or Services, with or without prior notice, where we reasonably believe that you have:

  • Breached these Terms;

  • Violated any applicable law or regulation;

  • Uploaded unlawful or prohibited content;

  • Attempted fraudulent or unauthorised transactions;

The remaining provisions shall remain in full force and effect.


46. No Waiver

47. Assignment

You may not assign, transfer, sublicense, or otherwise deal with your rights or obligations under these Terms without our prior written consent.

MagnetArt may assign or transfer its rights and obligations under these Terms as part of a merger, acquisition, corporate restructure, sale of assets, or other legitimate business transaction.


48. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Warranty Policy, and any other policies published on the Website, constitute the entire agreement between you and MagnetArt relating to your use of the Website and our Services.

They replace any previous understandings, communications, or agreements relating to the same subject matter.

Any provisions of these Terms that by their nature are intended to survive termination shall continue in effect after termination.
