MagnetArt – Malka Net Pty Ltd ("MagnetArt", "we", "our", or "us") respects the intellectual property rights of others and expects all customers using our Website and Services to do the same.

2. Customer Licence

By uploading content to MagnetArt, you grant us a limited, non-exclusive, royalty-free licence to:

  • Receive your files;

  • Store your files;

  • Resize and optimise images;

  • Crop images where necessary;

  • Print your uploaded content;

  • Manufacture your custom products;

  • Process warranty claims;

  • Produce replacement orders;

  • Provide customer support.

This licence exists solely for the purpose of fulfilling your order and related customer service.

MagnetArt does not claim ownership of your uploaded content.

3. Copyrighted Material

MagnetArt does not knowingly manufacture products that infringe the intellectual property rights of third parties.

Examples of content that may require authorisation include, but are not limited to:

  • Movie characters

  • Television characters

  • Comic book characters

  • Sports team logos

  • Corporate logos

  • Brand logos

  • Professional photographs

  • Artwork created by another artist

  • Licensed illustrations

  • Celebrity photographs

  • Copyrighted posters

  • Images downloaded from the internet without permission

The above examples are illustrative only and do not represent a complete list.

4. Right to Refuse Orders

MagnetArt reserves the right, at its reasonable discretion, to refuse, suspend, delay, or cancel any order where we reasonably believe that the uploaded content:

  • May infringe copyright;

  • May infringe trademark rights;

  • May infringe intellectual property rights;

  • May violate privacy or publicity rights;

  • May expose MagnetArt to legal or regulatory risk; or

  • May otherwise violate applicable law.

Where appropriate, we may request evidence of ownership or authorisation before proceeding with production.

5. Copyright Complaints

If you believe that material produced by MagnetArt infringes your copyright or other intellectual property rights, please contact us promptly.

6. Investigation

Upon receiving a complaint, MagnetArt may:

  • Review the complaint;

  • Request additional information;

  • Suspend production;

  • Delay shipment;

  • Remove uploaded content where appropriate;

  • Cancel an order;

  • Decline future orders relating to the disputed content; or

  • Take any other reasonable action necessary to comply with applicable law.

Submission of a complaint does not automatically establish infringement.

MagnetArt will review each matter individually.

7. Repeat Infringement

Where a customer repeatedly uploads content that appears to infringe third-party intellectual property rights, MagnetArt reserves the right to:

  • Refuse future orders;

  • Suspend or terminate customer accounts; or

  • Restrict access to our Website or Services.

8. No Obligation to Review

While MagnetArt may review uploaded content, we are under no obligation to inspect, verify, monitor, or investigate every file uploaded by customers.

Acceptance of an order does not constitute confirmation that uploaded content complies with copyright or intellectual property laws.

Customers remain solely responsible for the legality of all uploaded content.

9. Third-Party Intellectual Property

All trademarks, logos, brand names, product names, character names, images, and copyrighted materials belonging to third parties remain the property of their respective owners.

Any references to third-party intellectual property are for identification purposes only and do not imply any affiliation, sponsorship, endorsement, or approval by the respective rights holders.
